MEMBERSHIP AGREEMENT AND WAIVER

I, __________________________________ , agree to become a member of the Knickerbocker Sailing Association, Inc. (the "Corporation") and to abide by its By-Laws, rules and regulations as they may be constituted now and from time to time during my membership.

I understand that the purpose of the Corporation is to facilitate and encourage an interest in recreational boating among its members.

I understand that hereinafter the term Boat means boat, dinghy, motorboat, sailboat, ship, yacht, sea-going vessel or other craft used, or capable of being used, in navigation on water.

I understand that although from time to time the Corporation, its officers, and its members may facilitate events and associations among its members, guests, and friends for the purpose of sailing or boating, neither the Corporation, its officers or its members may make any representation as to the seaworthiness, safety, or reliability of any Boat or other equipment, nor as to the skill, experience, training or standard of care of any member of the Corporation. Nor does the Corporation, its officers or members make any representation that any member of the Corporation who operates any Boat and invites other members of the Corporation, their guests or friends onto the Boat, maintains any standard of liability insurance or otherwise possesses the capacity to compensate guests for damages they may incur from negligence or other operation of the Boat or its equipment.

As a condition of membership and participation by me in the activities of the Corporation, I agree to waive any claim that I might have against the Corporation, its officers, and/or its members or member for any injury which I or my guest or friend may incur as a result of any action of the Corporation, its officers, and/or its members in facilitating sailing, boating or related activities.

I understand that before I undertake to engage in the activities of the Corporation, it is my responsibility to make sure that others with whom I associate, including Boat owners and/or operators, possess the requisite skill, training, experience and diligence to secure my safety and that of my guests or friends, and that they also possess adequate liability insurance or other ability to compensate me and my guests or friends from any damage that they may incur.
